PRC suspends ‘utang tagging’ policy for license renewal

MANILA – The Professional Regulation Commission (PRC) has suspended its tagging policy contained in Memorandum Order No. 44 towards professionals with pending administrative cases which barred them from renewing their PRC licenses.

In a statement on Sunday, Labor Secretary Bienvenido E. Laguesma announced this, noting the suspension takes effect immediately.

The PRC is an attached agency of DOLE.

Resolution No. 1558, signed by PRC acting chairman Jose Cueto Jr. and commissioner Erwin Enad, was a response to the issue of “utang-tagging” raised by ACT Teachers Party-List Rep. France Castro in last week’s congressional deliberation of the DOLE budget.

Teachers are barred by the PRC from renewing their licenses for purportedly having unpaid debts under this policy.

Laguesma was concerned about the “utang-tagging” policy since it imposes an unreasonable burden on professionals with ongoing administrative proceedings.

“How can they pay what they borrow if they can’t work because the PRC won’t renew their licenses,” the Labor chief said.

Cueto stated that while “utang tagging” is halted, the PRC will evaluate and engage with its various professional boards in an effort to improve the efficiency and fairness of its processes and disciplinary procedures.

Laguesma commended the PRC for the immediate response to the issue, noting that this will provide not only teachers but also other professionals immediate relief.

While stressing that paying debts and professional discipline are still of the utmost importance, he clarified that the PRC should focus its regulatory function on undesirable acts deriving from the practice of the professions while evaluating its policies and disciplinary procedures.

He added that every regulation must pass the test of reasonableness and should not be used to penalize professionals merely because of their socio-economic factors.
