MANILA – According to the Commission on Elections (Comelec), holding a plebiscite for Charter Change within the current year or before the May 2025 midterm elections is unlikely.
Comelec Chairman George Garcia stated yesterday: “We’re running out of time getting ready for the elections in 2025. So, to conduct a plebiscite before the end of the year… it’s a little tight for the Comelec.”
“It’s already March. There’s still the procurement, preparations. It will not be possible to have a plebiscite this year,” Garcia added.
Garcia’s statement came in response to the urging of certain legislators to hold the plebiscite before the scheduled May 2025 National and Local Elections (NLE).
He emphasized that the Comelec is obligated to conduct the plebiscite whenever directed by Congress.
Regarding questions about the legality of holding a simultaneous plebiscite alongside the NLE, Garcia stated that it is premature to discuss the matter.
Currently, Garcia noted that the Senate and House of Representatives are still deliberating on the proposal for a simultaneous plebiscite with the NLE. He mentioned that the Senate advocates for holding both electoral events concurrently, while Congress prefers separate conduct for each.
“We at the Comelec will obey the order of the Senate and House of Representatives,” Garcia said.
He mentioned that if mandated by both houses of Congress, the Comelec is prepared to conduct the plebiscite concurrently with the National and Local Elections (NLE).
“If allowed to happen simultaneously, that is a legal and political issue, which the Comelec cannot interfere,” he explained. Garcia said the Comelec will respect the decision of the political departments.
Garcia emphasized that the final decision on the legality of holding the plebiscite alongside the midterm elections rests with the Supreme Court.
